1. Acceptance of Terms
By accessing or using any website, web game, or mobile application operated by OnvexaLabs (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Services.
2. Who We Are
OnvexaLabs is an indie game studio operated by Manfred Uschan. Our current services include the website onvexalabs-dev.github.io, the browser game Cracklash (cracklash.cc), and Android applications on Google Play. Contact: onvexalabs@gmail.com.
3. Eligibility
You must be at least 13 years of age (or 16 years of age if you are in the European Union) to use our Services. By using the Services, you represent that you meet this age requirement. If you are under the applicable age, you must obtain consent from a parent or legal guardian before using the Services.
4. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use our Services for personal, non-commercial entertainment purposes, subject to these Terms.
You may not:
- Copy, modify, distribute, sell or lease any part of our Services or software.
- Reverse engineer, decompile or attempt to extract the source code of our games or applications.
- Use automated tools, bots, or scripts to access or interact with the Services.
- Attempt to gain unauthorised access to any part of the Services or our servers.
- Use the Services in any manner that could damage, disable, or impair them.
- Use the Services for any unlawful purpose or in violation of any applicable regulation.
5. In-Game Content and Virtual Items
Our current games are free to play and do not offer in-app purchases or real-money transactions. Any virtual in-game items, scores, or progress data have no monetary value and cannot be exchanged for real money or transferred to other users. We reserve the right to modify, reset, or remove in-game content at any time without notice or compensation.
6. Advertisements
Some of our mobile applications display advertisements served by Google AdMob. These ads are provided by third parties and are subject to Google's own terms and privacy policy. We do not control the content of ads shown. You can adjust your ad personalisation preferences in your device settings.
7. Intellectual Property
All content included in or made available through the Services — including but not limited to text, graphics, logos, game assets, music, and software — is the property of OnvexaLabs or its licensors and is protected by applicable intellectual property laws.
You may not reproduce, distribute, publicly display, or create derivative works from any OnvexaLabs content without our express written permission.
8. User Conduct
When using any interactive features of the Services (such as leaderboards), you agree not to:
- Submit false, misleading, or fraudulent information.
- Harass, threaten, or harm other users.
- Upload or transmit viruses, malware, or other harmful code.
- Impersonate any person or entity.
- Exploit bugs or vulnerabilities to gain an unfair advantage.
We reserve the right to ban or block any user who violates these conduct standards.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ONVEXALABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED €50 (FIFTY EUROS).
11. Third-Party Services
Our Services may link to or integrate with third-party services (e.g. Google Play, Google AdMob, YouTube, X/Twitter, Linktree). These third parties have their own terms and privacy policies. We are not responsible for their content or practices.
12. Modifications to the Services
We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised date. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Austria, without regard to its conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Austria, unless mandatory consumer protection law in your country of residence requires otherwise.
